You agree to take full responsibility of all actions and not hold Penetrade, LLC or iTradeMobile Alert liable for any system defects. Although this application attempts its best effort to assure data accuracy, we do not and cannot give any express or implied warranty as to its accuracy. We do not accept any liability for error or omission; and by accepting this agreement and continuing to use this application, you agree that you acknowledge our term of service and agree to never hold the application provider, Penetrade, LLC, liable for any tangible and intangible damages as a result of any application usage, mis-usage, electronic transmission delay, and/or any type of errors.

You as the user, by using this system and accepting this agreement, acknowledges and agrees that iTradeMobile Alert makes no warranty whatsoever that any software downloaded onto user's device will be compatible with, or operate without interruption on. iTradeMobile Alert does not warrant the software to be error free, never explicitly nor implicitly guarantee any level of service. You hereby to accept such risks, including but not limited to, failure of or damange to, hardware, software, communication lines or systems, and/or other equipment. iTradeMobile Alert expressly disclaims any liability with respect to the foregoing, and you agree to fully indemnify, defend and hold harmless iTradeMobile Alert from any and all damanges, liabilities, losses, costs, and expenses that may arise therefrom.

This Agreement shall continue in effect until termination, and may be terminated by Subscriber at any time when Subscriber cancels the subscription, and acknowledged by iTradeMobile Alert.

Trading foreign exchange (forex) on margin carries a high level of risk, and may not be suitable for all investors. The high degree of leverage can work against you as well as for you. There are risks associated with utilizing an mobile-enabled, Internet-based software system; including, but not limited to, the failure of hardware, software, and Internet connection. Since iTradeMobile Alert does not control all aspects to successfully deliver content, including but not limited to its reception or routing via Internet, configuration of your equipment or reliability of its connection, we cannot be responsible for communication failures, distortions or delays when delivering content via our software. End users should always be ready to utilize another system in case of any unexpected failures.

The iTradeMobile Alert is a software and like all software out there, unknown defects do exist. By continuing subscription, User is acknowledged and will always be aware that there may be unknown defects in the system. User should take full responsibility of all actions and not hold iTradeMobile Alert liable for any system defects.

Users agree to not hold iTradeMobile Alert liable for any damange as a result of the misuse of the iTradeMobile Alert system. Users agree to take on responsibility to learn how to properly use the system, and only continue to use the iTradeMobile Alert system when users agree to take full responsibility of all consequences; including but not limited to: alerts not delivering on time, alerts deliver pre-maturely, and alerts never deliver.

This Agreement, and the rights and obligations of the parties hereto, shall be governed by, construed and enforce in all respects by the laws of the State of California, where iTradeMobile Alert's principal facility is located.
